Social Media and Divorce: Online Activities Can Come Back to Bite You
Spouses must be aware that voluntarily disclosed information can have serious implications for their future after divorce.
September 04, 2011 /Marriage - Relationships PR News/ -- Facebook profiles, blogs and other sites online have become the standard for communicating with close friends, relatives and the broader community. Staying in touch by sharing pictures and tales of family vacations, new arrivals and other news is easier than ever. But it is also public information that could become evidence in a contentious Florida divorce case.
American Academy of Matrimonial Lawyers president Linda Lea M. Viken recently told the New York Times of a choice example from her own practice. A parent seeking custody of his children had posted on his Facebook profile that "he was single with no children looking for a fun time." Evidence of alcohol or drug use, associations with certain individuals or infidelity can be offered as indications of character in divorce issues that look closely at "the best interests of the child."
Spouses must be aware that voluntarily disclosed information can have serious implications for their future after divorce. Just as important, they must remember that we live in a world where a private eye tailing a spouse's whereabouts is no longer necessary. Data from cell phones and GPS units, being tagged in another person's photo, or credit card purchases can all provide irrefutable evidence of something a person did not intend to disclose.
A Florida Family Law Attorney Can Explain the Legal Process
Every aspect of the divorce process, from child support and spousal support (alimony) determinations to modifications of custody terms due to relocation, can provide challenges that a client did not anticipate. Evidence of character is particularly important when it comes to child custody determinations. A divorce lawyer will help you understand the strengths and weaknesses of your case and pursue an appropriate legal strategy.
